Effective June 10, 2019, nationals of New Zealand are eligible for E-1 Treaty Trader and E-2 Treaty Investor visa status. As background, the E-1 category allows a foreign national from a country with which the U.S. has a commercial treaty to enter the U.S. solely to engage in trade of a substantial nature principally between the U.S. and the beneficiary’s country of nationality. Such trade must be international, substantial and continuous between the U.S. and the other treaty country. The E-2 category allows a foreign national from a country with which the U.S. has a commercial treaty to enter the U.S. and work for a company which has invested or is actively investing a substantial amount of capital. To be considered substantial, the investment must be a substantial percentage in proportion to the total value of the particular enterprise or must be an amount normally considered necessary to establish a viable enterprise.
